StickAI – Terms of Use

Welcome to StickAI (“StickAI,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the StickAI mobile application, website, and AI-powered sticker generation services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Description of the Service
StickAI is an AI-powered sticker generator app that allows users to create custom stickers using text prompts, images, or other inputs. Stickers generated through the Service may be used for personal or commercial purposes, subject to these Terms and applicable laws. StickAI does not guarantee uniqueness, originality, or suitability of generated stickers for any specific purpose.

2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are under 18, you represent that you have obtained consent from a parent or legal guardian.

3. User Accounts
Certain features may require account registration. You agree to:
– Provide accurate and current information.
– Keep your account credentials secure.
– Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.2 License to StickAI
By submitting User Content, you grant StickAI a worldwide, non-exclusive, royalty-free license to:
– Process User Content to generate stickers and provide the Service.
– Store and transmit User Content as necessary for app functionality.
– Use anonymized or aggregated data derived from User Content to improve our AI models and features.
We do not sell your User Content.

4.3 Content Responsibility
You agree not to upload content that:
– Violates any laws or regulations.
– Infringes copyrights, trademarks, or other intellectual property rights.
– Contains explicit, hateful, abusive, or misleading material.
– Violates the rights or privacy of others.
You are solely responsible for the content you upload and the stickers you generate.

5. AI-Generated Stickers
StickAI generates stickers automatically using artificial intelligence. You acknowledge that:
– Generated stickers may be similar or identical to those generated for other users.
– Stickers may unintentionally resemble copyrighted or trademarked material.
– You are responsible for reviewing and ensuring that your use of generated stickers does not infringe third-party rights.
StickAI does not provide legal clearance or intellectual property guarantees.

6. Intellectual Property
All intellectual property related to the Service—including software, algorithms, models, designs, and branding—belongs to StickAI or its licensors. You may not:
– Reverse-engineer or attempt to extract source code.
– Copy, sell, sublicense, or distribute the Service itself.
– Use the Service to create competing sticker-generation products.

7. Prohibited Uses
You agree not to use StickAI to:
– Generate illegal, harmful, or deceptive content.
– Impersonate individuals or brands without authorization.
– Create stickers intended to harass, threaten, or defame others.
– Circumvent security or abuse system resources.
We may remove content or restrict access if prohibited use is detected.

8. Payments & Subscriptions
Some features may require payment or subscription. By purchasing paid features:
– You agree to the pricing and billing terms shown at checkout.
– Payments are non-refundable unless required by law.
– Subscriptions may automatically renew unless canceled before the renewal date.
– Pricing and features may change with prior notice where required.

9. Third-Party Platforms
StickAI may allow export or use of stickers on third-party platforms (such as messaging or social apps). We are not affiliated with those platforms, and their terms and policies govern your use of stickers on their services.

10. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using StickAI, you consent to our data practices.

11. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, StickAI disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that generated stickers will be unique, error-free, or suitable for any specific use.

12. Limitation of Liability
To the maximum extent permitted by law:
– StickAI will not be liable for indirect, incidental, consequential, or punitive damages.
– Our total liability for any claim will not exceed the amount you paid to StickAI in the 12 months preceding the claim (or $100 if no payment was made).

13. Indemnification
You agree to indemnify and hold harmless StickAI and its affiliates from any claims, damages, losses, or expenses arising from:
– Your User Content.
– Your use of generated stickers.
– Your violation of these Terms or applicable laws.

14. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Provisions that should reasonably survive termination will remain in effect.

15. Changes to the Terms
We may update these Terms periodically. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
