TrendSense – Terms of Use

Welcome to TrendSense (“TrendSense,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the TrendSense website, mobile application, analytics tools, and AI-powered trend discovery services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

TrendSense does not guarantee that any content will go viral or achieve specific engagement metrics.

4. User Content

We do not sell your User Content.

You are solely responsible for your User Content and for complying with platform rules on TikTok, Instagram, YouTube, or other social services you interact with.

5. AI-Generated Insights & Trend Data

TrendSense may provide automated recommendations, trend predictions, analytics reports, or content ideas. You acknowledge that:

  • AI-generated insights may not always be accurate or up-to-date.
  • Predictions and analytics may not lead to increased engagement or virality.
  • Insights may be similar to those provided to other users.

TrendSense is not responsible for decisions or actions taken based on AI-generated data.

6. Intellectual Property

All intellectual property in the Service—including algorithms, software, trademarks, data models, and branding—belongs exclusively to TrendSense and its licensors. You may not:

  • Copy, distribute, or create derivative works of the Service.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Use the Service to build competing tools or datasets.

7. Prohibited Activities

You agree not to use TrendSense to:

  • Engage in unlawful, abusive, or fraudulent activities.
  • Scrape or harvest data in ways that violate platform terms.
  • Attempt unauthorized access to systems or servers.
  • Generate misleading or harmful media, including undisclosed AI-generated impersonation.

We may restrict access if prohibited conduct is detected.

8. Payment & Subscription Terms

Some features require a paid subscription. By subscribing, you agree that:

  • Fees are charged according to the pricing shown at checkout.
  • Payments are generally non-refundable unless required by law.
  • Subscription terms may auto-renew unless canceled before the renewal date.
  • Prices may change with prior notice when required.

Failure to pay may result in loss of access to premium features.

9. Third-Party Services

TrendSense may integrate with or reference third-party platforms, including social networks and analytics providers. We are not affiliated with or endorsed by TikTok, Instagram, YouTube, or any other platform. Their independent terms and guidelines apply to your content on those platforms.

10. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using TrendSense, you consent to our data practices.

11. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, including:

  • Warranties of merchantability or fitness for a particular purpose.
  • Warranties regarding accuracy, reliability, or completeness of AI insights.
  • Warranties that the Service will be uninterrupted, secure, or error-free.

TrendSense does not guarantee viral success or audience engagement.

12. Limitation of Liability

To the fullest extent permitted by law:

  • TrendSense is not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim is limited to the amount you paid in the 12 months prior to the event giving rise to the claim (or $100 if no payment was made).

13. Indemnification

You agree to indemnify and hold harmless TrendSense and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the Service.
  • Your User Content.
  • Your violation of these Terms or any applicable laws.

14. Termination

We may suspend or terminate access to the Service at any time for any reason, including violations of these Terms. You may discontinue use at any time. Certain sections—including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification—survive termination.
